California SB 1167 sits on the Governor's desk and rewrites the battery-certification definitions; unreturned, it becomes a statute on 30 September 2026

SB 1167 (Blakespear) was enrolled on 31 August 2026 and presented to the Governor on 4 September 2026 at 2 p.m. It amends Health and Safety Code sections 26300, 26302, 26303 and 26304 -- the battery-certification chapter SB 1271 created -- and a long list of Vehicle Code sections including 406, 407.5, 4020, the whole moped article at 5030 to 5039, 12804.9, 21113, 21960, 25650, 27803 and 38012. Several of those are sections PEVRA already cites across the California rows.

What it does to the definition this site quotes: enrolled SEC. 3 cuts Health and Safety Code section 26300(h)(1) from "includes any of the following" with four limbs to "includes either of the following" with two. The moped limb and the off-highway motorcycle limb are deleted, the motorized scooter stays, and the functional catch-all -- "Any other personal mobility device powered by a lithium-ion storage battery" -- survives, re-lettered from (D) to (B). Subdivision (h)(2), which excludes "a vehicle required to be registered with the Department of Motor Vehicles", is carried over word for word. So neither of the two gates in the California sale_certification row closes; what changes is the lettering and the strength of one argument about surplusage.

The date. California Constitution article IV, section 10(b)(2) says a bill passed by the Legislature before September 1 of the second calendar year of the biennium and in the Governor's possession on or after September 1 "that is not returned on or before September 30 of that year becomes a statute." SB 1167 was passed and enrolled on 31 August 2026 and presented on 4 September, so on the face of that paragraph it becomes law on 30 September 2026 unless the Governor returns it. PEVRA has not verified whether another paragraph of section 10(b) displaces (2) on these dates, so the date is recorded as what the constitution says rather than as a settled deadline.
