The law’s definition excludes this device by its shape.

No New Mexico helmet statute reaches an electric unicycle rider. The motorcycle helmet rule (under-18) reaches only a “motorcycle”, which the code defines by “a seat or saddle for the use of the rider” — a unicycle has neither. The Child Helmet Safety Act binds parents of riders under 18, but only for its own list — bicycle, skates, scooter, skateboard — whose definitions require pedals and a saddle, or handlebars; one untested reading is named on the Santa Fe page. Courts have held a city may still adopt its own helmet ordinance (City of Albuquerque v. Jones, 1975), so check the city page too. PEVRA’s advice does not change with the law: wear one.

No person under the age of eighteen shall operate a motorcycle unless the person is wearing a safety helmet that is securely fastened on the person's head in a normal manner as headgear
